These Terms of Service ("Terms") govern use of the Noxy iOS app and related services (the "Service"). Noxy is operated by Alvino Bernardo, an individual based in Indonesia ("Noxy," "we," "us," or "our").

By downloading, creating an account, purchasing Noxy Pro, or using the Service, you agree to these Terms and the Noxy Privacy Policy. If you do not agree, do not use the Service or purchase a subscription.
1. Eligibility
Noxy is currently unavailable in the European Union storefronts identified in our distribution settings. Availability may change; applicable consumer and privacy rights depend on the relevant law, not solely on storefront availability.
You must be at least 13 to create an account or use Noxy. Onboarding does not accept a date of birth younger than 13. Noxy is not intended for children under 13, and we do not knowingly collect personal information from anyone under 13.
Users aged 13 to 17 may use the Service only with the consent and supervision of a parent or legal guardian. If you permit a minor to use Noxy, you agree to supervise their use and accept these Terms on their behalf to the extent permitted by law. If we learn that we collected personal information from a person under 13, or from a user aged 13 to 17 without required consent, we will take appropriate steps to restrict the account and delete the information. If you believe this has happened, contact us.
2. Wellness service; no medical advice
Noxy is a consumer wellness and calorie-tracking tool. It helps users log meals, estimate nutrition, set calorie and macronutrient targets, keep wellness journals, and build tracking habits. After any onboarding or preview experience, continued access to Noxy's main features requires an active Noxy Pro subscription unless a purchase screen or promotion expressly says otherwise.
Noxy is not medical advice, diagnosis, treatment, or a medical device. It is not a substitute for a doctor, dietitian, or other qualified professional, and it does not guarantee any health, weight, or fitness outcome. Nutrition estimates, calorie targets, portions, timelines, and AI results may be inaccurate or incomplete.
Fox HP, appearance, and meal labels such as “healthy,” “mixed,” or “unhealthy” are game feedback derived from estimated nutrition, meal descriptions, and simplified scoring rules. They do not measure your health, diagnose a condition, or establish whether a food or diet meets your individual needs. Do not restrict food or change a care plan to improve a game score.
Consult a qualified professional before changing your diet, exercise, or calorie intake, especially if you are pregnant, under 18, have a medical condition, or have a history of disordered eating. Do not use Noxy for an emergency or urgent medical need.
3. Accounts and cross-device data
You may sign in with Apple, Google, or email and password. You must provide accurate information, protect your credentials, and promptly tell us about unauthorized account use. You are responsible for activity under your account.
When you are signed in, Noxy may sync your profile, body measurements, goals, plan settings, reminders, streak totals, and up to 90 recent journal entries across signed-in devices as described in the Privacy Policy. Progress totals are merged and stored by our servers, which decide the authoritative value.
Food logs, calories eaten, and attached photos sync to your signed-in account for a rolling seven days after each log was created. After that period, they expire from the app and recovery; physical cloud deletion is asynchronous as explained in the Privacy Policy. Saved foods and their attached photos have no automatic expiry and remain until you delete them or your account. Saving a food creates a separate library item; expiry or deletion of its original food log does not delete that saved item. Streak totals are kept separately from food history.
The updated cloud-sync service allows up to 500 records in each food collection: 500 retained food logs and 500 saved foods. Creating additional records may be refused until you remove items or eligible logs expire. Existing libraries above the limit can update or delete known items. A saved food having no automatic expiry does not mean unlimited storage. Cloud journal recovery includes up to 90 recent entries, and long notes may be shortened to fit the cloud limit.
Recovery requires signing in to the same Noxy account and applies only to changes that successfully reached our servers. Offline or unfinished changes, and local-only Siri drafts, can be lost if you uninstall or erase the app or lose the device before syncing. Signing out waits for confirmed saves; if saving fails, Noxy keeps the local data and asks you to retry. Noxy is not a permanent archive of food history.
You may delete your account through Settings. Deletion does not cancel an App Store subscription, does not erase records already saved in Apple Health, and clears local data only on the device completing deletion. Other limits are explained in the Privacy Policy.
Account deletion also queues a request to delete your account-linked PostHog profile and events. Processing begins no earlier than 24 hours after the request is queued and after your Noxy account has been deleted; PostHog then processes deletion asynchronously. This is not a promise of complete erasure within 24 hours. Signing out alone does not delete previously collected analytics information. 4. Subscriptions and billing
Noxy Pro is an auto-renewable subscription purchased through Apple's App Store. Noxy may offer weekly, monthly, or yearly billing periods. The exact subscription name, duration, localized price, included features, and any introductory offer are displayed before you confirm a purchase and control over any conflicting summary in these Terms.
Payment is charged to your Apple Account when you confirm the purchase. Unless you cancel at least 24 hours before the end of the current subscription period, the subscription renews automatically for the same period and Apple charges the then-applicable renewal price. Apple may notify you or require consent before a price increase where its rules or applicable law require it.
If Apple shows that you are eligible for a free trial or other introductory offer, you will not be charged during the stated free-trial period. Unless you cancel before the trial ends, the subscription automatically converts to the paid plan at the price and billing period shown on the purchase screen. Eligibility for introductory offers is determined by Apple and is not guaranteed.
You can view status, change plans, or begin cancellation through Noxy's Manage Subscription screen or your Apple subscription settings. Apple controls when an upgrade, downgrade, or crossgrade takes effect and whether any credit, proration, or refund applies. Canceling stops future renewals; you normally retain access through the end of the already-paid period. Deleting your Noxy account or uninstalling the app does not cancel the subscription.
If you opt in and allow notifications, Noxy may schedule a local reminder approximately one day before an eligible trial is expected to convert to a paid subscription. Delivery and timing are not guaranteed and depend on device settings and available subscription information. You remain responsible for canceling through Apple before the applicable deadline. A missing, late, or outdated reminder does not cancel, extend, or postpone the trial or renewal, without limiting any rights that cannot legally be excluded.
Apple processes payments and payment-card information. Refund requests are handled through Apple under its policies, without limiting refund or consumer rights that applicable law gives you against us.
Restore Purchases attempts to reconnect an existing eligible App Store subscription to your signed-in Noxy account. We do not guarantee that a purchase can be transferred between different Noxy, Apple, or store accounts where Apple or RevenueCat rules do not permit it.
5. AI nutrition estimates and menu information
With your permission, when you request an estimate, Noxy sends meal text and, if you choose photo analysis, a resized meal photo to its backend and Google Gemini. Estimates use Google Search grounding, and restaurant or branded-food requests may also use official menu sources. Details are in the Privacy Policy.
AI meal corrections send existing meal details and your correction for a new estimate. AI calorie tracking is a core feature of Noxy and requires permission for the processing described in the Privacy Policy. You can decline the notice; no AI estimate is sent without permission. Signing out clears your saved permission on that device. Declining or signing out does not change subscription billing.
AI requests are subject to rate and service limits. The current backend permits up to 60 estimate requests per account per hour, including a maximum of 20 photo estimates in that period. Shared network and abuse-prevention limits may temporarily restrict requests earlier. Noxy Pro does not provide unlimited AI requests.
You must review estimates before logging them. Confidence scores and source labels describe the estimate’s available evidence and are not guarantees of accuracy. Do not treat an estimate, menu result, calorie target, or suggested timeline as a laboratory measurement, clinical analysis, professional advice, or guarantee. Restaurant recipes, serving sizes, and published menu data can change without notice.
6. Your content
You retain ownership of content you submit, including meal descriptions, photos, journal notes, mood entries, saved meals, and profile inputs ("User Content").
You give Noxy a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and transmit User Content only as needed to operate, secure, and provide the Service and its processors. This includes processing AI requests, syncing your profile, streak totals, recent journals, retained food logs, saved foods, and their attached photos, displaying local widgets or Apple system experiences you enable, and responding to support requests. This license does not permit sale of your wellness, meal, photo, or journal content or its use for third-party advertising. It ends when the relevant content is deleted from our active systems, except for residual backups, legal records, or information that is not linked to your account, as explained in the Privacy Policy.
Do not upload unlawful, infringing, harmful, or unrelated content, or another person's sensitive information without permission.
7. Acceptable use
You may not misuse the Service; interfere with it; bypass authentication, App Check, rate limits, subscriptions, or security; reverse engineer it except where law permits; introduce malicious code; access other accounts; scrape it; impersonate others; use it for clinical care or regulated claims; or present Noxy estimates as clinical measurements.
8. License and intellectual property
Noxy and its name, fox branding, UI, software, and materials are owned by us or our licensors. Subject to these Terms, we grant you a personal, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. The app is licensed, not sold.
9. Third-party services and Apple terms
Apple Health integration is optional and depends on compatible hardware and the permissions you grant. Noxy can write permitted body measurements and meal nutrition and can read permitted Health information as described in the Privacy Policy. Imported weight can update your Noxy plan and signed-in cloud profile. Nutrition written to Health remains an estimate that you should review and correct before logging; it is not a clinical measurement or an Apple endorsement of accuracy.
Health sync may be delayed, incomplete, or unavailable. Review important records in both apps. Disconnecting Health, deleting your Noxy account, or uninstalling does not automatically erase records already saved in Health; manage permissions and delete those records in Apple Health. Other apps’ records and Apple's syncing or retention are outside Noxy's control.
The Service uses Apple, Google Firebase, PostHog, Google Gemini, RevenueCat, Resend for password-reset emails, and optional Google Sign-In. The website uses Vercel hosting and optional website analytics/performance measurement. Nutrition estimates use Google Search grounding, and some restaurant or branded-food lookups also use official third-party menu sources. Your use of those services may also be subject to their applicable terms and privacy policies. You must comply with applicable third-party terms when using Noxy. Third-party services may change, become unavailable, or return inaccurate information, but this paragraph does not remove responsibilities that applicable law places on us.
If you allow the first-launch prompt or enable it in Settings, PostHog provides product analytics and crash diagnostics to help us understand app usage and troubleshoot problems. Usage information includes events about onboarding, permission choices, meal logging and editing, saved foods, subscriptions, feedback submission, and return visits. When optional analytics is enabled and you are signed in, Noxy associates this activity with your account identifier and sends your email address and display name when available. PostHog also processes crash reports and associated app and device information. Our custom usage events do not include your actual meal text or photos, journal text, exact body measurements, or calorie and macronutrient values. In this app version, analytics is off until allowed. The first-launch prompt remembers either answer. You can change the choice in Settings → Your data; signing out resets the analytics account identity but does not change this installation’s choice. Accepting these Terms does not replace any separate consent required by applicable law for analytics or other personal-data processing, or waive your applicable privacy rights.
These Terms are between you and Alvino Bernardo, not Apple. Alvino Bernardo, not Apple, is solely responsible for Noxy and its content, maintenance, and support. Apple has no obligation to provide maintenance or support. Contact us using the information at the beginning of these Terms for questions, complaints, or claims.
To the maximum extent permitted by law, Apple has no warranty obligation for Noxy. If Noxy fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price paid for the app, if any. Apple has no other warranty obligation, and Alvino Bernardo is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a warranty failure.
Alvino Bernardo, not Apple, is responsible for addressing claims relating to Noxy or your possession and use of Noxy, including product-liability claims, claims that Noxy fails to meet a legal or regulatory requirement, and claims under consumer-protection, privacy, or similar laws. If a third party claims that Noxy or your possession and use of it infringes intellectual-property rights, Alvino Bernardo, not Apple, is responsible for investigating, defending, settling, and discharging that claim.
You may use Noxy only on Apple-branded products you own or control and as Apple's Usage Rules permit, including access through Family Sharing, volume purchasing, or Legacy Contacts where applicable. You represent that you are not located in a region subject to a U.S. Government embargo or designated by the U.S. Government as supporting terrorism, and that you are not listed on a U.S. Government prohibited- or restricted-party list. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, when you accept them, may enforce them against you.
10. Service changes, availability, and data loss
We may add, remove, limit, or change features, integrations, subscription offerings, or reasonable usage limits as Noxy evolves. Changes apply prospectively. We will not knowingly remove substantially all paid functionality during an active paid period without providing the access, notice, remedy, or refund required by Apple rules and applicable consumer law. We may suspend or discontinue all or part of the Service where reasonably necessary, including for security, legal, technical, or business reasons.
Network services, AI providers, official menu sources, account sync, and subscription verification may be unavailable, delayed, or inaccurate. We do not promise uninterrupted availability, but this does not limit obligations that cannot legally be excluded.
Food-history expiry is part of the Service described in Section 3. Keep any separate records you need for longer than seven days, and allow changes to finish syncing before removing the app. To the maximum extent permitted by law, Noxy is not responsible for loss of local-only content caused by uninstalling the app, device loss or failure, operating-system behavior, storage corruption, or actions taken through your account.
11. Disclaimers and liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND NON-INFRINGEMENT. THIS DISCLAIMER DOES NOT APPLY TO WARRANTIES OR CONSUMER GUARANTEES THAT CANNOT LEGALLY BE DISCLAIMED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOXY AND ALVINO BERNARDO ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS OR BUSINESS OPPORTUNITY, ARISING FROM USE OF THE SERVICE. WHERE A MONETARY CAP IS LEGALLY PERMITTED, OUR AGGREGATE LIABILITY FOR A CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR NOXY PRO DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $50.
Nothing in these Terms excludes, transfers, or limits responsibility for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, breach of a non-waivable consumer guarantee, or any other liability or consumer right that cannot legally be excluded or limited. If the law where you live provides a mandatory remedy, that remedy remains available to you.
12. Indemnity, suspension, and termination
To the extent permitted by law, you will be responsible for third-party claims and reasonable direct costs caused by your intentional unlawful use of the Service, infringement through User Content you submitted, or material breach of these Terms. This obligation does not apply to the extent a claim was caused by our acts or omissions and does not require a consumer to waive non-waivable rights.
You may stop using the Service at any time. We may suspend or end access if you violate these Terms, create risk, misuse subscriptions or accounts, or if we discontinue the Service. Provisions that should survive, including intellectual-property, disclaimer, liability, data-loss, and indemnity provisions, survive termination.
13. Changes and disputes
We may update these Terms prospectively as the Service or law changes. For material changes, we will update the Last updated date, state when the revised Terms take effect, and provide reasonable additional notice in the Service or by email where appropriate. A change will not retroactively reduce rights for an already-paid subscription period. We will request affirmative consent where applicable law requires it. If you do not agree to revised Terms, you must stop using Noxy and cancel future subscription renewals before the revision takes effect.
These Terms are governed by the laws of the Republic of Indonesia, excluding conflict-of-law rules. Disputes are subject to the competent courts of Indonesia, unless mandatory consumer protections where you live require otherwise. Please first contact alvino.support@gmail.com so we can try to resolve a dispute informally.
14. General
If a provision is unenforceable, it will be limited only as needed and the remaining Terms remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a reorganization, financing, merger, acquisition, or asset transfer only subject to applicable law and without removing non-waivable consumer rights. These Terms and the Privacy Policy are the entire agreement concerning the Service, except for purchase terms displayed by Apple at checkout and any rights that applicable law gives you.
